TERMS AND CONDITIONS AGREEMENT
1-CALIBRATION SERVICE
ISO/IEC 17025 is an international standard that assesses the technical competency of calibration laboratories. ISO/IEC 17025 covers every aspect of laboratory management, ranging from testing proficiency to record keeping and reports. Services will include:
a. All calibration standards will be traceable to the National Institute of Standards and Technology (NIST).
b. Calibration recall notification will be provided to each device a month prior to the calibration due date.
c. If repairs and/or replacement are required prior to performing the service, an estimate of time and cost will be provided. Repairs will be done only with customer approval.
d. The service level, either with or without data, or ISO 17025 w/uncertainties, is to be determined on a per item basis.
e. Traceable certificates of calibration will be provided only when the unit passes the test. As-found and as-left data will be recorded and provided to the customer if requested by customer in writing prior to service.
f. Calibration due date showing on the calibration certificate and label.
1.1 SPECIAL CALIBRATION REQUESTS
Any special calibration requests, including but not limited to specific test points, non-standard ranges, customized procedures, or reporting requirements requested by the customer, must be provided in writing prior to calibration. Verbal requests will not be accepted. All special requests are subject to contract review and laboratory approval before work is performed.
2-RECORD KEEPING
A.V.C. Laboratory will maintain calibration and repair records for a minimum of five (5) years, unless otherwise required by regulation or contract. Records are protected from damage, deterioration, and unauthorized access. A.V.C. Laboratory will create a calibration certificate only when units pass the test. A.V.C. Laboratory will not make changes to technical reports related to calibration results, date of calibration or any information that could affect the authenticity of reports.
3-PRICING
Our calibration turnaround time is 5-7 Business-Days, not including repairs. In the event repairs are required and approved, completion may take an additional 10 Business Days or longer, aside from the initial 5-7 Days. (Please note Repairs cannot be expedited). Expedite service is available at additional charges per item: 24-Hours: $50.00 or 60% of the calibration price, per item, whichever is greater. 48-Hours: $35.00 or 40% of the calibration price, per item, whichever is greater.
Excess dirt/grime/deposits on tooling that requires additional labor to be removed in order to properly calibrate will be billed at an hourly rate of $50.00 per hour in addition to the calibration cost for the tool. If a unit is in for repair there will be an evaluation fee applied depending on the magnitude of the evaluation of 20% of the repair quote or $150.00 USD, per item, whichever is greater. Customers will be notified prior to the service being provided.
Inspection & Evaluation Fees:
An evaluation fee will be charged if this quote is not approved. $50.00 for hand tools $150.00 for all other equipment The evaluation fee will be credited and deducted from the final approved quote.
A.V.C. Laboratory recommends that all special instructions and/or unique requirements be clearly listed in the documentation provided when equipment is submitted for calibration (e.g., packing slip, Test Points and/or repair order or purchase order). The customer is responsible for all inbound and outbound shipping charges. Additional charges may apply for adjustments, repairs, or replacement parts. If such services are required, a revised quote will be issued for customer approval prior to proceeding.
4-SHIPPING AND RETURNS OF EQUIPMENT
Unless otherwise stated by A.V.C. Laboratory, delivery of instruments shall be as follows:
- Equipment will be delivered to clients via preferred freight carrier.
- Shipment and transportation expenses shall be paid by the client.
- The client shall determine whether shipments should be insured by notifying A.V.C. Laboratory in writing of this option and the amount of insurance for each shipment.
- Should no insurance be applied it is understood A.V.C. Laboratory Inc. waives liability in the event damages occur during shipment from (AVC) facility to designated facility.
Instruments shipped by A.V.C. Laboratory are carefully packed before leaving our facility.
5-TERMS OF PAYMENTS
Invoices are due and payable in full upon receipt/COD unless other terms have been agreed by A.V.C. Laboratory. Methods of payment accepted include Company Check, and Credit Card (Visa/ MasterCard/Amex).
Net thirty (30 days) credits are available with approved customer credit application.
6-LIMITED WARRANTY
All calibrations have a 30-day warranty from the date of service, unless the unit is found to have broken or removed Cal-Void Seals or has obvious physical damage. The warranty is limited to recalibration of instruments only and specifically excludes any liability for injuries, lost time, or damaged product.
A.V.C. Laboratory warrants that any item calibrated by it, found to be out of tolerance within thirty (30) days, due to defects in workmanship, including parts or process, will be recalibrated at no charge if such item is returned to Company’s facility, at the Customer’s expense.
Electrical damage not related to calibration will be at the customer’s expense. There is not warranty for Electrical equipment’s.
7-CHANGES OF TERMS AND CONDITIONS OF SERVICES
If a current or future provision of the concluded contract should be or become, in whole or in part, invalid/void or unenforceable for reasons other than those stated in these terms and conditions, the validity of the remaining provisions of the contract shall not be affected.
7.1- IMPARTIALITY AND CONFIDENTIALITY
A.V.C. Laboratory conducts all calibration activities in a manner that ensures impartiality and safeguards the confidentiality of all customer information, in accordance with ISO/IEC 17025.
7.2- NONCONFORMING WORK
If nonconforming work is identified, the customer will be notified, and corrective actions will be implemented in accordance with laboratory procedures.
7.3- SUBCONTRACTED CALIBRATION SERVICES
When calibration services are subcontracted, A.V.C. Laboratory ensures that external providers are competent and meet applicable ISO/IEC 17025 requirements. Customers will be notified when subcontracting is required.
CUSTOMER’S RESPONSIBILITY
8-ON-SITE CALIBRATION
When work is performed at a customer’s site, it is the responsibility of the customer to have instruments available in advance of the scheduled date and allow for access to the tooling in order to accommodate calibration and to facilitate steady workflow. A.V.C. Laboratory requests the Customer’s cooperation in providing the on-site technician(s) with an environmentally controlled area to perform calibrations and to stage instruments. This area must have proper lighting and electrical service as well as adequate space to set up our work equipment. If equipment cannot be safely calibrated on-site, it must be taken to the calibration laboratory for service.
9-IN-HOUSE CALIBRATION
A.V.C. Laboratory provides safety handling of customer equipment during receiving, testing, and packing. Turnaround time for each regular service is three to five (3 to 5) working (business) days. A.V.C Laboratory also offers expedite services 24hr (see number 3 or contact service representative for more details) as well as critical On-Site services.
It is the customer’s responsibility to ensure that instruments sent to the laboratory are free of contamination in accordance with State & Federal transportation and/or safety requirements.
10-CALIBRATION INTERVALS
Calibration intervals are to be determined by the instrument “owner” based on manufacturer recommendations or on equipment owner’s internal quality procedures. A.V.C Laboratory will make a recommendation regarding the accuracy of the intervals determined by the Customer based on tools manual or Client function Quality.
If the calibration interval is not specified in the purchase order or recorded in the A.V.C Laboratory files from prior customer instruction, the laboratory will assign one (1) year calibration cycle interval for all equipment. Calibration due dates Are determined by the customer.
11-SCHEDULING AND APPOINTMENTS FOR SERVICE
Regular services, Rush or on-site, will be scheduled by email or phone call from customers. The customer is responsible for requesting on-site and Rush services with sufficient notice to meet their internal requirements.
A.V.C Laboratory will schedule a tentative date based on the instruments’ due date.
12-DELIVERIES AND PICK UP
A.V.C Laboratory will offer deliveries and pick-up at the client’s facility at no extra charge, unless the distance exceeds 20 miles or previous agreement.
It is the customer’s responsibility to request pick-up and delivery services.
